SATCO Receives Favorable Decision on IPR filed Against Seoul Patent Assertion
NEW YORK (Sept. 13, 2021) – Satco Products, Inc., a leading supplier of lighting products for the commercial, residential, and industrial markets, today announced that it has received a favorable decision from the U.S. Patent and Trademark Appeal Board (PTAB), invalidating all claims of a patent which had been asserted by Seoul Viosys Co. Ltd. and Seoul Semiconductor Co. Ltd. (Seoul).
Specifically, after Seoul filed a litigation in the Eastern District of New York with unsubstantiated allegations of patent infringement, Satco filed petitions for inter partes review of U.S. Patent Nos. 9,343,631, 10,134,967, and 8,860,331. On Sept. 10, 2021, the PTAB determined that Satco “has shown, by a preponderance of the evidence, that all of the challenged claims [of U.S. Patent No. 9,343,631] are unpatentable.” This latest setback for Seoul follows earlier decisions by the PTAB on inter partes reviews filed by Satco, finding unpatentable all challenged claims in U.S. Patent No. 10,134,967 and one challenged claim in U.S. Patent No. 8,860,331.
Satco will continue to aggressively defend its products and protect its customers from unwarranted claims of patent infringement from entities, who unfairly attempt to extract royalties from industry participants based on patents with suspect validity. In addition to invalidating numerous claims from multiple patents asserted by Seoul, Satco has also filed a lawsuit against Seoul in the Northern District of Georgia for infringement of several valuable Satco patents.
Satco is represented by Scott J. Bornstein, who serves as Co-Chair of the Global Intellectual Property & Technology Group at Greenberg Traurig, LLP, along with firm Shareholders Nicholas A. Brown, Heath J. Briggs, Andrew D. Sommer, and Stephen M. Ullmer, as well as Robert P. Lynn, Jr. and Katherine Smith Santos of Lynn Gartner Dunne, LLP.
“Satco is pleased with the decisions from the U.S. Patent and Trademark Office and plans to continue to vigorously defend itself against claims believed to be meritless made by Seoul and others,” Bornstein said.
